These Terms of Service ("Terms") govern your access to and use of ELDT.Courses, including our website at eldt.courses and our learning platform at moodle.eldt.courses (collectively, the "Services"). Please read them carefully. By accessing the Services or enrolling in a course, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to enroll in our courses. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

2. Account Registration

To enroll in courses, you'll need to create an account on our Moodle learning platform. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the confidentiality of your password.
  • Be responsible for all activity under your account.
  • Notify us immediately of any unauthorized access at terry@eldt.courses.

3. Course Enrollment and Payment

When you enroll in a course, you agree to pay the listed price plus any applicable taxes. Payment is processed through Stripe or PayPal. Upon successful payment, you receive immediate access to the course materials through our Moodle platform.

All prices are in U.S. dollars. We reserve the right to modify course pricing at any time, but changes will not affect courses you've already purchased.

4. Refund Policy

Full refunds are available within 7 days of purchase if you have not accessed any course content.

Once you have accessed any course content (including viewing lessons, taking quizzes, or downloading materials), the course is considered consumed and is non-refundable. This is standard for digital and downloadable products.

To request a refund, email terry@eldt.courses within the 7-day window with your order number. We will process eligible refunds within 5 business days back to your original payment method.

Exceptions:

  • Technical issues preventing course access that we cannot resolve within 7 days will be refunded in full.
  • Duplicate purchases made in error will be refunded.

5. Intellectual Property

What we own

The original course content created by ELDT.Courses — including our written explanations, video instruction, illustrations, slides, quizzes and assessments, the structure and sequencing of our curriculum, our brand identity, and the look and feel of our platform — is owned by ELDT.Courses and Terence Mullins.

What we don't claim to own

Our courses incorporate content from public, third-party, and federal sources, including but not limited to:

  • Federal Motor Carrier Safety Regulations (49 CFR), which are part of the U.S. federal government's public domain.
  • Materials, forms, and guidance published by the FMCSA, DOT, and state licensing agencies.
  • Excerpts from state CDL manuals and other publicly available regulatory materials.
  • Brief quotations and references from third-party publications, used for educational commentary, criticism, instruction, and analysis under the doctrine of fair use as codified at 17 U.S.C. § 107.

We do not claim ownership of public domain material or content authored by others. Where third-party material is used, we either rely on fair use, properly attribute the source, or use it under license. Inclusion of such material in our courses does not transfer ownership to ELDT.Courses, nor does it grant you any rights to the underlying source material beyond those you already have under law.

Your license

When you enroll, you receive a limited, personal, non-transferable license to access and use our original course materials for your own learning and professional development. This license covers our original instructional content; it cannot grant rights we don't hold over third-party or public-domain material.

What you may do

You retain all rights granted to you under the U.S. Copyright Act, including fair use. You may:

  • Take personal notes from course materials for your own study and reference.
  • Quote brief excerpts for educational discussion, commentary, or review.
  • Discuss course concepts and what you've learned with others.
  • Apply the knowledge from our courses in your professional work.

What you may NOT do

You agree NOT to:

  • Share your login credentials — each enrollment is for one individual.
  • Download, record, screen-capture, or systematically copy substantial portions of our original course materials for distribution or storage outside our platform.
  • Resell, sublicense, repackage, or republish our original content.
  • Use our original content to train artificial intelligence or machine learning models.
  • Create derivative courses or commercial training programs substantially based on our original instructional design.
  • Reverse engineer or attempt to extract proprietary materials.
  • Misrepresent your training source, completion status, or credentials to employers, regulators, or any third party.

Fair use and these terms

Nothing in these Terms limits any rights you have under fair use (17 U.S.C. § 107), the First Amendment, or any other applicable law. Reasonable, good-faith use of our original course materials for personal study, criticism, commentary, news reporting, teaching, scholarship, or research is permitted. Uses that substitute for purchasing the course, or that compete commercially with our offerings, are unlikely to qualify as fair use.

Concerns about our use of third-party material

If you believe we have used copyrighted material in a way that exceeds fair use or proper attribution, please contact us at terry@eldt.courses. We take these concerns seriously and will review and respond promptly.

Material violations of the license terms above — particularly credential sharing, systematic copying, or commercial reuse of our original content — may result in immediate account termination without refund and potential legal action.

6. Course Completion and FMCSA Reporting

Our courses are FMCSA-approved Entry-Level Driver Training (ELDT) theory courses. Upon completion of a course (passing all required assessments at 80% or higher), we report your completion to the federal Training Provider Registry (TPR) as required by 49 CFR Part 380.

7. Acceptable Use

When using our Services, you agree NOT to:

  • Violate any applicable law or regulation.
  • Harass, threaten, or harm other students, instructors, or staff.
  • Submit false information during enrollment or course completion.
  • Attempt to gain unauthorized access to our systems.
  • Use the Services to send spam, malware, or other harmful content.
  • Misrepresent your course completion status to employers, the FMCSA, or any third party.

8. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Specifically:

  • Our courses are theory-only training. They do not constitute behind-the-wheel (BTW) training, which must be completed separately with an FMCSA-registered BTW provider.
  • Successful completion of our courses does not guarantee that you will pass your state CDL knowledge test or skills test, or obtain a Commercial Driver's License.
  • State CDL requirements vary; you are responsible for understanding your state's specific requirements.
  • Industry employment is not guaranteed, regardless of training completion.

9. Limitation of Liability

To the maximum extent permitted by law, ELDT.Courses, Terence Mullins, and our service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost wages, lost employment opportunities, or loss of data, arising from your use of the Services.

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the total amount you paid us for the specific course at issue, or one hundred dollars ($100), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless ELDT.Courses, Terence Mullins, and our service providers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of course materials, or your violation of any third party's rights.

11. Account Suspension and Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abusive behavior, or any other reason that materially threatens the Services or other users. Upon termination, your right to access the Services ceases immediately. Refunds for terminated accounts are at our discretion.

12. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of the Services after changes constitutes acceptance of the new Terms. For material changes, we'll provide reasonable advance notice via email.

13. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to personal jurisdiction in those courts.

Before filing any legal claim, you agree to first contact us in good faith at terry@eldt.courses to attempt to resolve the matter.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, along with our Privacy Policy and FMCSA Compliance page, constitute the entire agreement between you and ELDT.Courses regarding the Services.
